Individual Hearings

The full hearing where you present your case to the judge.

An individual hearing, sometimes called a merits hearing, is where you present your case. You may testify, bring witnesses, and submit documents. The government’s attorney can ask questions, and the judge decides whether you qualify for the relief you requested. The decision may be given at the end of the hearing or later in writing.

Preparation matters. Evidence and witness lists are often due before the hearing date, and your testimony should be consistent with your written statements. Our attorney can represent you in matters she accepts.

Who this is for

  • People with a hearing date set by the judge
  • People who need to organize evidence and witnesses
  • Families who want to understand the process

What to expect

We work backward from your hearing date: confirm the filing deadlines, gather and organize evidence, prepare declarations and witnesses, and practice the questions you are likely to be asked. Interpreters are provided by the court for hearings.

What to bring

  • All documents and evidence related to your application
  • Contact details for witnesses
  • Identification and any court notices
  • Records of any prior filings
This service is provided by our licensed attorney for matters the attorney accepts. Vista staff who are not attorneys do not provide legal advice. This page is general information and does not replace advice about your own situation.

Questions

Can I bring family members or friends?

Immigration court hearings are usually open to the public, but whether someone can testify depends on your case and the judge’s instructions. Ask the attorney before the hearing.
