What is a Request for Evidence (RFE) and what to do next

October 7, 2026 · 1 min read · Vista Immigrant Support

A Request for Evidence (RFE) is a letter from USCIS saying it needs more information before it can make a decision on your application or petition.

It is not a denial

Receiving an RFE does not mean you were denied. It means something is missing or unclear. But it needs your attention right away.

Read it carefully

  • Find the response deadline printed on the notice. It is firm.
  • Underline every item USCIS lists.
  • Check the return address or instructions for where to send the response.

Build a complete response

  • Answer every item in the notice, even if you think it is repeated elsewhere.
  • Include the original RFE notice as the top page of your response package.
  • Send copies unless the notice asks for originals.
  • Include certified English translations of any foreign-language documents.
  • Keep a copy of everything you send, and use a mailing method with tracking.

Do not wait

Gathering documents such as civil records or tax transcripts can take time. Start immediately. Bring the notice to us as soon as it arrives and we will help you list what is requested and gather it. For legal review of your response, our licensed attorney can help with matters she accepts.
